1. About Octavello

This website is operated by Everlion, trading as Octavello.

Throughout these Terms, “Octavello”, “we”, “us” and “our” refer to Everlion. “You” and “your” refer to anyone accessing our website or purchasing from us.

By using our website or placing an order, you agree to these Terms and the policies referenced within them. If you do not agree, you must not use the website.

2. Eligibility and Website Use

You must be at least 18 years old or have permission from a parent or legal guardian to place an order.

You agree to:

Provide accurate and complete information;
Use an authorised payment method;
Use the website only for lawful purposes; and
Not interfere with the security or operation of the website.

We may restrict or suspend access where we reasonably suspect fraud, unlawful activity, misuse or a security threat.

3. Products and Information

We make reasonable efforts to present product descriptions, specifications, images, colours, prices and availability accurately.

However:

Colours and appearance may vary between devices;
Product packaging may change;
Minor differences may occur between images and delivered products; and
Availability may change without notice.

We may modify or discontinue products that have not yet been ordered.

4. Orders and Acceptance

Placing an order is an offer to purchase the selected products.

An automated order-confirmation email confirms that we received your order. It does not guarantee acceptance, availability or dispatch.

We may reject or cancel an order before acceptance if:

The product is unavailable;
Payment cannot be authorised;
The delivery information is incomplete or invalid;
The order appears fraudulent or unlawful;
Purchase or delivery restrictions apply; or
An obvious pricing or product-information error has occurred.

If we cancel a paid order, we will refund the relevant amount to the original payment method.

We may limit quantities where reasonably necessary to manage stock, prevent fraud or restrict unauthorised commercial resale.

5. Prices and Payment

Prices are displayed in the currency indicated on the website.

Applicable delivery charges, taxes and other amounts collected by Octavello will be shown before payment. Additional customs or import charges may apply where disclosed in our Order and Delivery Policy.

Prices may change without notice, but changes will not affect orders already accepted.

You must provide accurate billing information and be authorised to use the selected payment method.

6. Processing and Delivery

Products may be supplied and shipped by international suppliers or fulfilment centres, including facilities in Asia.

Processing times and delivery dates are estimates unless expressly confirmed otherwise. Delays may occur because of carriers, customs or circumstances outside our reasonable control.

Orders containing multiple products may arrive in separate parcels.

7. Cancellations, Returns and Refunds

Cancellations, returns, exchanges, faulty products and refunds are handled under our Return and Cancellation Policy.

Cancellation cannot be guaranteed after processing has started. Products must not be returned without first contacting us and receiving return instructions.

The return address may differ from the address shown on the delivered parcel.

8. Accounts and Customer Information

If you create an account, you are responsible for keeping your login information confidential and for activity conducted through your account.

Notify us immediately if you suspect unauthorised access.

Personal information is handled as described in our Privacy Policy.

9. Third-Party Services and Links

Our website may use services provided by Shopify, payment processors, carriers, applications and other third parties.

We are not responsible for the availability, content, security or practices of independent third-party websites or services that we do not control.

Any transaction entered into directly with an independent third party is governed by that party’s terms. This does not remove any responsibility Octavello has for services performed on our behalf in connection with your order.

10. Intellectual Property

The Octavello website and its content—including branding, logos, text, graphics, photographs, layouts and software—are owned by or licensed to Everlion and protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial purposes. You may not copy, reproduce, distribute, sell, modify or commercially exploit its content without prior written permission.

11. Reviews and Submitted Content

If you submit a review, image, comment or other content, you confirm that you have the right to provide it and that it is not unlawful, misleading, abusive or infringing.

You grant Octavello a non-exclusive, worldwide and royalty-free licence to display, reproduce and use the submitted content in connection with our website, products and marketing.

We may remove content that violates these Terms. We will not materially change the meaning of a customer review.

12. Prohibited Activities

You must not use the website to:

Commit or encourage unlawful activity;
Submit false or misleading information;
Infringe intellectual-property or privacy rights;
Upload viruses, malware or harmful code;
Attempt unauthorised access;

To the maximum extent permitted by law, Octavello and Everlion will not be liable for:

Indirect, incidental, special or consequential losses;
Loss of profit, revenue, opportunity, goodwill or data;
Loss caused by misuse of a product or failure to follow instructions;
Loss caused by inaccurate information supplied by you;
Independent third-party websites or transactions;
Unauthorised access caused by your failure to protect account credentials; or
Delays or failures caused by circumstances outside our reasonable control.

Where liability can lawfully be limited, our total liability arising from an order will not exceed the amount you paid for the product giving rise to the claim.

This limitation does not apply to fraud, wilful misconduct, gross negligence, death or personal injury where liability cannot legally be limited, or any other liability that applicable law does not permit us to exclude.

15. Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, severe weather, transport disruption, industrial action, customs delays, government restrictions, war, civil unrest, epidemics or major network failures.

We will take reasonable steps to reduce the effect of such events and provide any remedy that cannot lawfully be excluded.

16. Suspension and Termination

You may stop using the website at any time.

We may suspend or terminate access where reasonably necessary because of fraud, unlawful conduct, a security threat or a serious breach of these Terms.

Termination does not affect rights, payment obligations or accepted orders that arose before termination.

We may update these Terms to reflect changes to our website, services, business practices or obligations.

Updated Terms will be published on this page with a new effective date. Changes will not retrospectively alter an order already accepted unless required by law or agreed with you.

18. Severability and Waiver

If any provision is found to be unlawful or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

A delay in enforcing any right does not permanently waive that right.

19. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands.

Any mandatory protections available to you under applicable consumer law remain unaffected.

Before starting formal proceedings, please contact us so we can attempt to resolve the issue directly.

Subject to any mandatory right to bring a claim elsewhere, the courts of the Netherlands will have non-exclusive jurisdiction over disputes relating to these Terms.
